Abstract

Islamic Law gives great importance to property after protection of human body. Numerous legal verdicts have been laid down to protect it from any kind of aggression or transgression. Islamic law has provided punishment to those who steel someone’s property from his custody without his consent. It has also been ordered to not eat one’s property illegally. If someone is killed in protecting his own property from an aggressor, he, in the eyes of Islamic Law is a martyr. In Islam, significance of property is also proved from the last sermon of the Prophet (PBUH) who mentioned it immediately after sanctification of human blood. The present article discusses the viewpoints of different jurists regarding protection of property who have argued about its hukm. Most of the jurists opined that protection of property is obligatory while some others are of the view that it is only permissible. The article also discusses the situation if the aggressor is killed during the process of defence of the property by the owner. In the last, protection of property has been comparatively viewed in conventional and Islamic Laws of property.
